On participation in the bonus program “Pamper with points” of the company Aurika LLP.

  1. GENERAL PROVISIONS
    1. Hereby Aurika Limited Liability Partnership, hereinafter referred to as “the Seller”, offers individuals to conclude an agreement on participation in the bonus program (hereinafter referred to as the Agreement) in the manner and on the terms provided for in this offer.
    2. Acquisition of the Bonus Card by the Buyer and its activation is a full and irrevocable consent to accept the terms of this offer.
    3. The Bonus Card is intended for personal use by its owner in order to accumulate and use bonuses and is not transferable to third parties.
    4. The Buyer has the right to withdraw from the offer (Agreement) at any time.
  2. TERMS AND DEFINITIONS
    1. Organizer is Aurika Limited Liability Partnership. Legal address: 17 Kuishi Dina street, Nur-Sultan city, 010000, Republic of Kazakhstan; tel. +7 (7172) 400-595. Official website: www.aurika.kz
    2. Participant’s Activity (Activity) is a conditional characteristic that reflects the number of Goods purchased by the Participant, as well as his/her fulfillment of other conditions of the Program.
    3. Questionnaire is a special electronic form that serves as a means of collecting information about the Program Participant.
    4. Bonus is a unit used to assess the degree of the Participant’s Activity, in exchange for which the Program Participant may be provided with various Preferences.
    5. Information space – Website, Personal account, publics in social networks Facebook, Instagram.
    6. Client is an individual who purchases fuel and goods from the supermarket.
    7. Personal Account is an online service on the Website that allows the client to access information about his/her Activity.
    8. Rules for Participation in the Program (Rules of Participation) is a document that determines the procedure for participation in the Program, as well as the conditions for granting Preferences to Participants.
    9. Preferences are tools to encourage Program Participants (Bonuses, discounts, promotional codes, participation in promotional games, promotions, etc.).
    10. Pamper with Points Incentive Program (Program) is a set of measures aimed at attracting new and stimulating the purchasing activity of existing customers of Aurika filling station network based on the principle of identifying a participant in such a program.
    11. Operator is an employee of the Trading Facility who sells Goods and Services.
    12. Website is a website cabinet.aurika.kz, aurika.kz, which contains the Personal Account, Rules, promotional offers and other information about the Program.
    13. Means of identification (Identifier) is a tool for identifying the Participant in the Program (by presenting a plastic card, mobile phone number), the information on which is linked to an account in the Program.
    14. Goods are all goods, including Fuel and non-fuel goods, sold at the Seller’s trading facilities.
    15. Fuel is an oil products sold through fuel dispensers at the Aurika gas station.
    16. Program Participant (Participant) is a Client who has expressed a desire to participate in the Program and presents an Identifier when making purchases in accordance with the Participation Rules.
  3. GENERAL CONDITIONS FOR PARTICIPATION IN THE PROGRAM
    1. Any individual can be a Participant of the Program.
    2. Participation in the Program allows to:
      1. Accumulate and use Bonuses when making purchases.
      2. Store and use information about completed transactions using the Identifier.
      3. Receive other Preferences in accordance with paragraph 5 of these rules, as well as promotions held within the framework of the Aurika gas station network.
    3. The program is valid for the purchase of Goods at the gas station when paying in cash, with a bank payment card.
    4. Participation in the Program is expressed in the acquisition by the Participant of the Goods in the Trade Facilities with the presentation of the Identifier, as well as the fulfillment of other conditions of the Program, while the Participant is credited with Bonuses in accordance with paragraph 5 of these Rules.
    5. The conditions for the size of the Bonus provision are determined by the Coordinator and are specified in paragraph 5 of these Rules.
    6. By taking actions aimed at joining the Program and receiving Preferences under the Program, the Participant confirms that he/she has read these Rules, agrees with them and undertakes to comply with them.
    7. The Participant who has joined the Program undertakes to independently monitor the presence of changes and additions to the Rules.
  4. QUESTIONNAIRE AND PERSONAL DATA OF THE PARTICIPANT
    1. The questionnaire is filled out electronically on the website.aurika.kz, through the company’s mobile application or at the gas station.
    2. By filling out the Questionnaire, the Participant agrees with the Rules for participation in it and allows the Coordinator, as well as on his/her behalf by third parties, to process all the data specified in the Questionnaire, including collection, systematization, accumulation, storage, clarification (updating and changing), as well as disclosure and transfer to third parties.
    3. The Coordinator undertakes to use the Participant’s personal data solely for the purposes of the Program.
    4. The Participant is solely responsible for the relevance and reliability of the information specified during registration, and undertakes to independently monitor and update this information, including when changing the mobile phone number.
  5. PROCEDURE FOR CALCULATION OF BONUSES
    1. The Coordinator credits the Participant with Bonuses to the Account in accordance with paragraph 5 of these Rules.
    2. To accrue Bonuses, the Participant presents the Identifier to the Seller in the process of making a purchase.
    3. Bonuses are accrued automatically at the time the Participant makes a purchase with the presentation of the Identifier. If there is no connection with the server, the time for displaying Bonuses in the Personal Account may be up to 72 hours.
    4. The number of Bonuses accrued on the current purchase is not more than 5 units of goods per day and is indicated in the Personal Account, as well as in the receipt.
    5. The Coordinator is not responsible for non-accrual of Bonuses if the Participant has not presented the Identifier in a timely manner.
    6. The Participant can receive information about the total number of Bonuses in the Personal Account of the company’s mobile application or from the Seller upon presentation of the Identifier.
    7. When returning the Goods purchased by the Participant under the Program, the Coordinator deducts from his/her Account the number of Bonuses corresponding to what was credited to the Participant’s Account when he/she purchased the specified Goods.
    8. The Participant undertakes to present the Identifier to the Seller when returning the Goods purchased with the presentation of the Identifier.
  6. BONUS USE PROCEDURE
    1. The Coordinator debits the Participant’s Bonuses from the Account in accordance with paragraph 7 of these Rules.
    2. Bonuses become available for withdrawal (use) only after registration of a Bonus Card.
    3. Bonuses accrued for the current purchase can be written off as a discount only in relation to subsequent purchases.
    4. The Participant with Bonuses can get a discount on the Goods by applying the previously accumulated Bonuses and paying up to 100% per unit of the Goods in the receipt, but not more than 20,000 bonuses per day.
    5. The list of Goods for which the Participant cannot use Bonuses is specified in paragraph 7 of these Rules.
  7. TERMS OF ACCRUATION AND USE OF BONUSES
    1. Bonuses are charged for each liter of fuel purchased at the gas station.
    2. Bonuses are calculated according to the following scale: DF – 1 bonus per liter, AI-92, 95 – 4 bonuses per liter.
    3. Calculation of Bonuses for discounts.
      1. Bonuses are exchanged for discounts on Goods (except for the goods specified in paragraph 5.3.4). The use of Bonuses is possible only at the time of making payment for the purchase, before the fiscal check is cashed.
      2. Bonuses are valid indefinitely, but despite this, the company has the right to terminate the Program at any time by giving notice of termination 1 (one) month before the expected date of termination at the gas station and on the Company’s Website.
      3. The Client can use only one Bonus Card to pay for goods with Bonuses and pay with Bonuses up to 99.99% of the cost of any product, fuel, but not more than 20,000 Bonuses per day.
    4. Bonuses are not awarded and discounts are not provided for the following categories of Goods:
      1. Tobacco products (including electronic cigarettes) and accessories to them, as well as non-tobacco nicotine-containing products.
  8. INFORMATION SUPPORT OF THE PROGRAM
    1. Information support of the Program consists in the dissemination of information containing information about these Rules, promotions and other events held under the Program and aimed at its promotion.
    2. Information support includes:
      1. general information about the Program;
      2. informing the Participant personally.
    3. General information is provided by placing relevant information by the Coordinator, advertising in the media (radio, press, Internet), placing posters, brochures and other types of printed materials.
    4. Informing the Participant personally is carried out through:
      1. providing him/her with information about transactions made using the Identifier with the help of a cash receipt issued upon purchase;
      2. sending him/her a letter via e-mail, SMS (if the relevant data is indicated in the Questionnaire);
      3. posting information in the Personal Account.
    5. When making a purchase at the Trade Facility with the presentation of the Identifier, the Participant is issued a cash receipt which indicates the following information: the number of bonuses for the current date.
    6. In the Personal Account, the Participant can view all transactions made with the presentation of the Identifier for the periods of interest to him/her, the amount of the discount received, accumulated and written off bonuses.
  9. OTHER CONDITIONS
    1. Aurika LLP reserves the right to unilaterally change the Rules for participation in it, informing the Participant of such changes by posting relevant information in the Information Space or in any other way no later than one month before the entry into force of such changes.
    2. The Coordinator has the right to conduct special promotions for Participants within the framework of the Program.
    3. The Identifier is active throughout the duration of the Program.
    4. The Participant is obliged to take all possible measures to prevent damage or loss, as well as the use of the Identifier by third parties. The Coordinator is not liable to the Participant for the use of the Identifier by third parties, including when third parties write off Bonuses from the Participant’s account.
    5. The Participant has the opportunity to use the Preferences only in case of using an active, valid Identifier for personal purposes. If the Identifier is blocked, the Participant is not entitled to use the Preferences during the blocking period.
    6. The Buyer is solely responsible for the consequences that may arise as a result of the loss of the Card. Replacement of a plastic card lost or damaged by the Participant is not provided. To resume Participation in the Program, the Participant acquires a new plastic card on general terms. Aurika LLP is not responsible for the Card if it is lost by the Buyer or stolen by third parties.
    7. If a Participant violates the Participation Rules, the Coordinator reserves the right to block the Participant’s ID without notifying him/her.
    8. All disputes related to Participation in the Program can be considered by the Coordinator only upon presentation of an electronic copy of the relevant checks. All disagreements and disputes that may arise from the Agreement or in connection with it, the Seller and the Buyer shall resolve through negotiations out of court. If such settlement of disputes and disagreements is impossible, they are subject to transfer to the location of the Seller for resolution in accordance with the legislation of the Republic of Kazakhstan.
    9. The duration of the Program is set by the Coordinator.
    10. The Program does not allow the aggregation of Participants’ Accounts and/or the transfer of Bonuses from one Participant to another.
  10. OFFER VALIDITY
    1. This offer comes into force from the moment this text is published on the Seller’s website www.aurika.kz and is valid until it is withdrawn by the Seller by posting an appropriate announcement on the Seller’s website or notifying the Buyer by any means of communication.
    2. Validity and modification of the contract:
      1. The Contract comes into force from the moment of acceptance of the offer and is valid until the expiration of the Card or until the termination of the Contract by agreement of the Parties. The Seller has the right to unilaterally terminate the Contract by notifying the Participants by posting the relevant information in the Trading Facilities and the Information Space no later than one month before the expiration of this Contract.
      2. The Buyer agrees and acknowledges that making changes to this offer entails making these changes to the concluded and valid Contract between the Seller and the Buyer, and these changes to the Contract come into force simultaneously with such changes in this offer.
      3. If the Participant is not satisfied with the work of the Program, does not agree with the Rules of Participation, or has lost interest in it for other reasons, he/she has the right to refuse further participation in the Program at any time by ceasing to present the Identifier when making purchases in the Trading Facility.

Please read carefully the text of the Public Offer, and if you do not agree with any paragraph of the Offer, you are welcome to refuse to participate in the Program.

In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan (hereinafter referred to as the CC of the Republic of Kazakhstan), this document is a Public Offer, and if the above conditions are accepted, the person accepting this Offer pays for the Seller’s Goods in accordance with the terms of this Contract. In accordance with paragraph 3 of Article 396 of the CC of the Republic of Kazakhstan, payment for the Goods by the Buyer is an acceptance of the Offer which is considered equivalent to the conclusion of the Contract on the conditions set forth in the Offer.
